Madonna's Adoption Petition Denied

Madonna No one expected this one, certainly not Madonna.  Not even when the ruling on her petition was delayed last week.  When Justice E.J. Chombo denied her adoption petition on Friday courtroom observers said she was shocked, appalled even.  "An incredulous Madonna kept wringing her hands."  The Judge said over and over again Madonna did not meet the Malawi residency requirements, which is 18 to 24 months in Malawi.  Although Madonna has homes in London in New York, she does not have a home in Malawi.  Madonna's lawyer, Alan Chinula,  has filed a notice to appeal the ruling with the Malawi Supreme Court, according to Ken Manda, high court registrar.

The judge said she had "a gripping temptation" to approve the adoption, but decided doing so would open doors to child trafficking, court records show. My question is, why are we so concerned with the rules now when we weren't when she adopted David?  She was granted custody and allowed to take him out of the country two years earlier without meeting the residency requirements. Different judge?  Backlash from the first adoption?  Ask two lawyers the same question you get a different answer? 

The rejection was based on a residency requirement and the judge's belief that the child was in good hands at an orphanage.  "There is a gripping temptation to throw caution to the wind and grant an adoption in the hope that there will be a difference in the life of even just one child," Justice E.J. Chombo wrote in a ruling.  "But removing the very safeguard that is supposed to protect our children ... could actually facilitate trafficking of children by some unscrupulous individuals."  The judge also said that because Madonna is already assisting other orphans, the child will still benefit from Madonna's generosity. 

The Judge did briefly address what she felt the difference between this adoption and the last one was.  This Judge did not handle David's adoption. David "was to be returned to his biological father within a period of six months from the time that Mchinji Orphanage had admitted him," Chombo wrote. "This is the same father that had desperately appealed for help after the death of his wife because of his incapacity to look after David and the unwillingness of wife's family to care for the child."In the case of this child, the orphanage taking care of her was able and willing.  Court records show her 14-year-old mother died days after her birth.  Her father is still alive.  It is unclear why he is not caring for her.

I do not agree that an ORPHANAGE is the same as a family.  But, the law is what the law is.  What still does not make sense to me, and the above paragraph does not really answer it, why did they not follow the law the first time, but decide to do it, THIS TIME? 

The denial was applauded by a coalition of local nonprofits. "Inter-country adoption is not the best way of providing protection to children ... supporting children from outside our country only helps five of the 1.5 million orphans we have," said Mavuto Bamusi, the national coordinator of Malawi Human Rights Consultative Committee.

Even her ex, Guy Ritchie supports her.  And they didn't exactly have a nice divorce.  He issued a statement through his rep.  “I fully supported Madonna in her decision to apply for this adoption, and I am saddened that her application has been rejected. She is motivated only by being a caring parent who seeks to share some of the advantages and opportunities that her life has given her.  Madonna is a fantastic and loving mother who cares deeply about her own children, and children who may need additional help and support.  This time it did not work out, but there will be other opportunities and I wish her well in them. She is a great mum.”  

I have a huge issue with news organizations showing pictures of this 3 year old child, and will not post one here.  She is entitled to privacy.  If she is not adopted by Madonna, she will go back to being any other child in an orphanage in Malawi.  She did not chose this publicity, and therefore, I am choosing to respect her privacy.  This is not something I have discussed with the overlords at Mamapop, or other Mamapopers, and they can do what they will, but this is my personal feelings.  She is a little girl, she has no idea the firestorm around her.  Leave her alone.

Madonna has left Malawi to celebrate Passover with her family.  Right, because MADONNA is now Jewish.  As a Jew, I have to say this, studying Kabbalah does not a Jew make.  But that is a whole other post.

Being a bit entrenched in international adoption myself, I can tell you exactly why the rules have changed since David's adoption: UNICEF. They are breathing down the necks of most 3rd world countries, trying to halt international adoption. UNICEF policies are pushing governments to leave kids in institutions to preserve their culture at the expense of their development. It's a huge political movement right now, but also financially motivated. And all of it comes at the expense of children left to be raised by staff in an orphanage, which will never take the place of a family.
