More Legal Issues in the Tiger Woods Saga

327px-Tiger_Woods_2004 Police still want to speak to Tiger.  His representatives have provided the police with his driver license information, vehicle registration and current proof of insurance, as required by Florida Law and say that is all he has to do.  How smart is it to play hard ball when all these questions still exist?

Here is the latest around the web in Woods legal land:

  • The Florida Highway Patrol (FHP) may be “obtaining a search warrant — allowing them to seize medical records from the hospital that treated Tiger Woods — in an attempt to determine if the wounds Woods sustained are consistent with a car accident or domestic violence” (allegedly perpetrated against Woods by his wife).
  • The mistress, Rachel Uchitel, or not, depending on who you ask, has retained Gloria Alred and is planning a defamation lawsuit against the National Enquirer.

One of my favorite legal blogs, Above The Law, has turned this case into a law school hypothetical, asking, do the police have probably cause?  And, will Rachel win her defamation case?

My answers, yes, they have a suspicious car accident and evidence to the contrary, and, the defamation case will never go to trial.  Or never even see a lawsuit.  Gloria Alred likes to talk a big game.

Possibly true, but this is kinda a gossip blog (although a way tasteful one by comparison) so I think it's kinda what we do here to gossip.

Contrary to your assertions, it's very smart not to talk to the police. You can only have probable cause if you need information to investigate a crime. This was a single car accident on private property. Unless the neighbor wants to press charges against Tiger Woods, or Woods wants to press charges against his wife, what is the alleged crime that the police are investigating? Why in the world would Woods and his wife talk to the police (unless he wanted some kind of protection from her)?

I don't know Florida law but here in Alaska DV cases are investigated whether the victim wants it or not. This is due to so many victims forgiving their attackers and not breaking the DV cycle.

I really feel like making a "LEEEEAAAVVVEEE TIIIGERRR ALOOOOOOOONE" video. Honestly I think a lot of people are making a bigger deal of this than it is b/c there he's so bland.

BTW, I've been in a similar situation with my husband where I had a massive meltdown in the middle of the night, but it wasn't because I was mad at him, it was because I had a dream I was going to be pregnant forever. He took off like a bat out of hell, got me some ice cream, and all was right with the world. Wonder what would have happened if we'd had a post or tree in that corner of our yard that he ran over when he left....

Would we be saying that everyone should back off and leave them alone if the roles were reversed and this was a potential DV case where the wife was attacked? Probably not.
