Steelers' Ben Roethlisberger Will Not Face Assault Charges

Ben-Roethlisberger Steelers' quarterback Ben Roethlisberger will not be charged in the March bar incident.  “The sexual allegations against Mr. Roethlisberger cannot be proven beyond a reasonable doubt; therefore, there will be no arrest made nor criminal prosecution of Mr. Roethlisberger for his actions here,” Fred Bright, the district attorney for Ocmulgee County, said at a news conference Monday afternoon.

The alleged victim in the case wrote a letter in the case several weeks after the incident saying she did not want to proceed with the prosecution because she could not handle the intense media media scrutiny involved in the case.  Kind of makes a case of he said, she said, hard to prove.  You can read the letter here.   

But, at the press conference, Bright also gave more tawdry details of the event, which go to show that Ben may not be so innocent after all.  Ben gave alcohol to the underage victim and her sorority sisters.  They then bar hopped together and had "sexual conversations."

“Everyone agrees that the victim was highly intoxicated,” Bright said. Later, Bright said, one of Roethlisberger’s bodyguards escorted the woman down a back hallway and Roethlisberger followed her into a small bathroom — Bright said it was less than five feet wide.  “Significant questions about what occurred persist,” Bright said.  After the encounter the women was driven to the hospital by friends and she was examined.  The doctors noted a superficial laceration, bruising and slight bleeding in her genital area, but that everything else was normal and that the doctor could not say definitively that the bruising was from any kind of trauma or sexual assault.

“Every case must be viewed in the context of its circumstances,” Bright said. “Here, the overall circumstances do not lead to a viable prosecution. We are not condoning Mr. Roethlisberger’s actions that night. We do not prosecute morals. We prosecute crimes.”

This may give more weight to the idea that the NFL or the Steelers plan to discipline him themselves.  N.F.L.  Commissioner Roger Goodell plans to meet with Ben this week and could suspend him for violating the NFL's conduct policy.

Ben than gave his own press conference in the Steelers' locker room to a small group of press.  "I'd like to begin by expressing gratitude for the thorough investigation process in Georgia and the prosecutor's decision not bring charges."

He continued, "I know without a doubt that it was the right conclusion. I don't intend to discuss any details relating to the events in Georgia, and I'm happy to put this behind me and move forward."

Ben also stated, "I'm truly sorry for the disappointment and negative attention I've brought to my family, teammates, coaches, the Rooneys, and the NFL. I understand the opportunities I've been blessed with are a privilege and that much is expected of me as the QB of the Pittsburgh Steelers."

Roethlisberger concluded, "I absolutely want to be the leader this team deserves, valued in the community and a role model to kids. I have much work to do to earn this trust and I'm committed to improving and showing everyone my true values. I'm excited to get back to work w/my teammates and more determined than ever to have a great season."

The words on the wall behind him in that pic are so fitting - "I'm used to going out at 3am and doing something stupid." It seems that this is Ben's mantra.

I was studying interpersonal trauma (including sexual assault and rape) at Miami University at the same time that Ben was attending. Miami has an alarmingly high rate of sexual violence reported on and off campus. I would not be surprised if Miami served as a source of indoctrination for Ben about ways to take advantage of women.
